Terms of Service

Terms and conditions for using FinOpenPOS

These Terms of Service ("Terms") govern your use of the FinOpenPOS demo application hosted at fin-open-pos.johnenrique.tech (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.


1. Acceptance of Terms

By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.


2. Description of Service

FinOpenPOS is an open-source point-of-sale (POS) system with a Brazilian fiscal module (NF-e/NFC-e). The hosted version at fin-open-pos.johnenrique.tech is a demonstration environment provided for evaluation and testing purposes.

2.1 Demo Nature — Important Warning

This is only a demo for the convenience of those who are curious. FinOpenPOS is designed for self-hosting. The online demo is ephemeral — all data will be lost at any time without prior notice. We strongly discourage any real use of the online demo.

You understand and agree that:

  • This is a demonstration environment, not a production-ready service
  • All data is ephemeral — it may be reset, deleted, or lost at any time without prior notice as part of maintenance, updates, or infrastructure changes
  • The Service may experience downtime without advance warning
  • Features may be added, modified, or removed at any time
  • The demo is not suitable for processing real customer data or real financial transactions
  • We are not responsible for any data entered into the demo, including its loss, exposure, or misuse

2.2 Sensitive Data — Strong Disclaimer

Do NOT upload or enter sensitive personal information, real documents, or digital certificates (A1/A3) and their passwords into the online demo. We assume no responsibility for any sensitive data entered into the demo environment.

We strongly discourage and assume no responsibility for users who:

  • Upload digital certificates (PFX/PKCS#12 files) or enter their passwords
  • Enter real CPF, CNPJ, or other government-issued identification numbers
  • Enter real customer personal data (names, addresses, phone numbers, emails)
  • Enter real financial data (bank accounts, credit cards, transactions)
  • Use the demo to issue real fiscal documents (NF-e/NFC-e) in production environments

The demo environment does not offer the same security guarantees as a self-hosted instance under your control. If you wish to test fiscal features with real certificates, deploy your own instance following the self-hosting guide.


3. Open Source License

The FinOpenPOS software is licensed under the MIT License. The complete source code is available at github.com/JoaoHenriqueBarbosa/FinOpenPOS.

The MIT License permits you to use, copy, modify, merge, publish, distribute, sublicense, and/or sell copies of the software, subject to the conditions specified in the license. These Terms of Service apply specifically to the hosted demo instance, not to self-hosted deployments of the software.


4. User Accounts

4.1 Registration

To use the Service, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your credentials.

4.2 Account Security

You agree to:

  • Provide accurate registration information
  • Keep your password secure and not share it with others
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

5. Acceptable Use

You agree not to use the Service to:

  • Process real customer personal data or real financial transactions
  • Violate any applicable local, state, national, or international law
  • Transmit malicious code, viruses, or other harmful technology
  • Attempt to gain unauthorized access to the Service, other accounts, or related systems
  • Interfere with or disrupt the Service or its infrastructure
  • Use the Service for any illegal, fraudulent, or abusive purpose
  • Scrape, mine, or otherwise extract data from the Service through automated means
  • Impersonate any person or entity

6. Data Ownership

6.1 Your Data

You retain ownership of any data you enter into the Service. We do not claim any intellectual property rights over your content.

6.2 Data Loss

Given the demo nature of the Service, you acknowledge that we are not responsible for data loss. You should not rely on the Service for permanent data storage. We recommend using the open-source software in a self-hosted environment for any data you wish to preserve.


7. Fiscal Module Disclaimer

The fiscal module (NF-e/NFC-e) is provided for testing and evaluation purposes only. When using the fiscal module:

  • Use only the SEFAZ homologation (testing) environment
  • Do not issue real fiscal documents through the demo instance
  • Tax calculations are based on the software's implementation and may not reflect current tax rates or regulations
  • You are solely responsible for compliance with Brazilian tax law in any production use

8. No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • The results obtained from the Service will be accurate or reliable
  • Any errors in the Service will be corrected
  • The Service will meet your specific requirements

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE FINOPENPOS COMMUNITY, ITS CONTRIBUTORS, OR MAINTAINERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.


10. Indemnification

You agree to indemnify and hold harmless the FinOpenPOS community, its contributors, and maintainers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service or your violation of these Terms.


11. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.


12. Modifications to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms. For significant changes, we will make reasonable efforts to notify users.


13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil. Any disputes arising from or in connection with these Terms shall be submitted to the competent courts of Brazil.


14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.


15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and FinOpenPOS regarding your use of the Service and supersede any prior agreements.
